Nesse artigo, mostraremos que, no argumento de Anselmo de Cantuária, “aquilo em relação ao qual nada maior pode ser pensado”, antes que uma definição, é a significação do próprio nome de Deus. Segundo esse argumento, ao não se dar ao trabalho, exigido pelo caráter apofático do nome divino, de praticar a ascese necessária para adentrar a própria mente e afastá-la de tudo mais que não Deus, o insipiens abdica da racionalidade do pensamento. Assim, sem dar a devida atenção ao fato (...) de que essa discussão de Anselmo é proposta no formato de uma quaestio medieval, os comentários posteriores, e especialmente os contemporâneos, acabam não mostrando que, ali, Anselmo, inspirado em Agostinho, desenvolveu o que, para ele mesmo, era propositalmente um programa filosófico: afastar-se do sensível a fim de se voltar para o inteligível, “lugar natural da contemplação da verdade”. Resumo: Este artigo tem por objetivo analisar as diferenças técnicas e militares entre o exército normando de Guilherme da Normandia e o exército anglo-saxão de Haroldo Godwinson que se confrontaram na Batalha de Hastings de 1066. Para isso, utilizamos como fontes a Tapeçaria de Bayeux e a Crônica de Guilherme de Poitiers, bem como dialogamos com a historiografia da história militar inglesa. Dessa forma, observamos que as diferenças de armas e estratégias existentes entre os exércitos anglo-saxões e normandos, influenciadas pelas (...) condições econômicas e sociais de ambos, favoreceram a vitória das forças invasoras normandas no campo de batalha. Este trabajo defenderá la universalidad de la metáfora en arte (Arthur Danto), contra quienes piensan (Davidson, Carrol, Vilar) que en él la atribución de propiedades expresivas es literal y no metafórica. Se defiende la tesis de que la metáfora artística es como un símbolo tensivo que apunta a significados (epífora) y al mismo tiempo crea presencia (diáfora). Gracias a ambos elementos el arte crea presencia, crea realidad o transfigura lo usual y le otorga súbitas y asombrosas posibilidades de presencia, (...) a las cuales se corresponde no sólo con los sentidos, sino también con el afecto, el entendimiento y la imaginación. Although cognitive science was multidisciplinary from the start, an under-emphasis on anthropology has left the field with limited research in small scale, indigenous societies. Neglecting the anthropological perspective is risky, given that once-canonical cognitive science findings have often been shown to be artifacts of enculturation rather than cognitive universals. This imbalance has become more problematic as the increased use of Western theory-driven approaches, many of which assume human uniformity (“universality”), confronts the absence of a robust descriptive base that might provide (...) clarifying or even contrary evidence. We highlight the need for remedies to such shortcomings by suggesting a two-fold methodological shift. First, studies conducted in indigenous societies can benefit by relying on multidisciplinary research groups to diminish ethnocentrism and enhance the quality of the data. Second, studies devised for Western societies can readily be adapted to the changing settings encountered in the field. Here, we provide examples, drawn from the areas of emotion and facial expressions, to illustrate potential solutions to recurrent problems in enhancing the quality of data collection, hypothesis testing, and the interpretation of results. There has been much debate recently on the question whether essence can explain modality. Here, I examine two routes to an essentialist account of modality. The first is Hale's argument for the necessity of essence, which I will argue is — notwithstanding recent attempted defences of it — invalid by its very structure. The second is the proposal that it is essential to essential truth that it is necessary. After offering three possible versions of the view, I will argue that (...) each fails to provide a metaphysical explanation of necessity in terms of essence. (shrink)

In this book, Carlos Montemayor and Harry Haladjian consider the relationship between consciousness and attention. The cognitive mechanism of attention has often been compared to consciousness, because attention and consciousness appear to share similar qualities. But, Montemayor and Haladjian point out, attention is defined functionally, whereas consciousness is generally defined in terms of its phenomenal character without a clear functional purpose. They offer new insights and proposals about how best to understand and study the relationship between consciousness and attention (...) by examining their functional aspects. The book's ultimate conclusion is that consciousness and attention are largely dissociated. -/- Undertaking a rigorous analysis of current empirical and theoretical work on attention and consciousness, Montemayor and Haladjian propose a spectrum of dissociation—a framework that identifies the levels of dissociation between consciousness and attention—ranging from identity to full dissociation. They argue that conscious attention, the focusing of attention on the contents of awareness, is constituted by overlapping but distinct processes of consciousness and attention. Conscious attention, they claim, evolved after the basic forms of attention, increasing access to the richest kinds of cognitive contents. -/- Montemayor and Haladjian's goal is to help unify the study of consciousness and attention across the disciplines. Pero que esta intuición varía dramáticamente si se plantea la pregunta a partir de un caso concreto que movilice una respuesta emocional de rechazo, en cuyo caso la mayoría se decanta por apreciar responsabilidad moral incluso en un universo determinista. Freire is one of the most powerful voices challenging the hegemony of bureaucratic and banking educational systems. His voice was particularly influential impacting revolutionary processes and progressive social movements while at the same time learning from their practices. However, some silences in his oeuvres requires further examination. In this article, we focus on the silences of Freire regarding education and its relationship with work and labor, gender issues, and citizenship building.

The Whorfian hypothesis has received support from recent findings in psychology, linguistics, and anthropology. This evidence has been interpreted as supporting the view that language modulates all stages of perception and cognition, in accordance with Whorf’s original proposal. In light of a much broader body of evidence on time perception, I propose to evaluate these findings with respect to their scope. When assessed collectively, the entire body of evidence on time perception shows that the Whorfian hypothesis has a limited scope (...) and that it does not affect early stages of time perception. In particular, all the available evidence shows that the scope of language modulation is limited in the case of time perception, and that the most important mechanisms for time perception are cognitive clocks and simultaneity windows, which we use to perceive the temporal properties of events. Language modulation has distorting effects, but only at later stages of processing or with respect to specific categorization tasks. The paper explains what is the role of these effects in the context of all the available evidence on time cognition and perception. (shrink)

This article presents what I call the Central Normative Proposal of Luis Villoro. This proposal is based on an interpretation of the principle of non-exclusion in ethics and epistemology. The core argument of the paper is based on a linguistic analogy that demonstrates the importance of reasonable communication for non-exclusion in epistemology, which is assumed in various theses of Villoro. A consequence of this analogy for non-exclusion in ethics is that Villoro defends basing what is reasonable on the concrete possibilities (...) of mutual understanding, starting with asymmetries and injustices that are obfuscated or eliminated in a contractualist analysis, or one that begins with strictly egalitarian principles. This criticism is compatible with egalitarian views, but it assumes a radically different point of departure. Although various theses by Villoro are compatible with egalitarian notions, given this point of departure based on asymmetries of power his proposal should be understood based on our cognitive capacities to understand and appreciate such asymmetries. For this reason, the paper concludes with an analysis of the notion of reasonableness, which under my interpretation Villoro defines in terms of our capacities for attention, that are not reducible to beliefs or systems of beliefs. In this way, the Central Normative Proposal of Villoro depends on the convergence between truth and the dignity of the members of communities in which as matter-of-fact asymmetries exist and must be eliminated through concrete communicative efforts. Después de enseñar la asignatura de Ética, y de la aplicar unas normas familiares escolares tradicionales, los estudiantes no se apropian de elementos éticos por varias causas: no les ven utilidad, no comprenden el contexto, o simplemente no les afecta, anulando cualquier interés al respecto. Esto impide que su obrar en la cotidianidad no sea tolerante en su ambiente escolar, generando dificultades en el docente para mediar comportamientos opuestos a una cultura de paz. Ante esto, se propone la Filosofía para (...) Niños (FpN) como apuesta ético-política que permita robustecer el pensamiento crítico, creativo y cuidadoso para mirar hacia una cultura de paz. Diego Pineda, el fundador de FpN en Colombia, sostiene que es necesario desarrollar en los estudiantes habilidades de pensamiento que, adicionales a conocimientos éticos-ciudadanos, los lleve a tomar decisiones acertadas en el abordaje pacífico del conflicto. El desarrollo paulatino del pensamiento, la cercanía a las comunidades de indagación, la incursión en habilidades cognitivas y éticas producto de las herramientas pedagógicas propias del programa de FpN, constituyen una preparación para asumir posiciones argumentadas frente a dilemas que acontecen dentro de los conflictos escolares, ello facilitará al estudiante estructurarse y lograr tomar decisiones iluminadas por la razón. Este estudio examinó el uso creciente de los Derechos de la Naturaleza como un enfoque para gestionar la administración terrestre. La Constitución de Ecuador de 2008 destaca por incorporar el concepto indígena de Pachamama, reconociendo a la naturaleza como titular de derechos. A través del análisis de los casos del río Whanganui en Nueva Zelanda y los glaciares Gangotri y Yamunotri en India, ambos en 2017, argumento que, aunque el discurso sobre los derechos individuales se fundamenta en la subjetividad moderna (...) y en el constitucionalismo de los estados nacionales seculares, se revela como una herramienta transcultural eficaz para legitimar la gestión humana del planeta en la era del Antropoceno. Defiendo que el emergente debate sobre los derechos de la naturaleza ofrece una base sólida para la administración terrestre y se compone de dos iniciativas clave diseñadas para superar los límites de la modernidad europea. Este enfoque basado en derechos establece obligaciones hacia la naturaleza que van más allá de los meros intereses humanos y reconoce el saber indígena como un dominio argumentativo alternativo. Así, las cosmovisiones indígenas se convierten en parte integrante de los Derechos de la Naturaleza, gracias a dos aspectos fundamentales del Antropoceno que están siendo cada vez más aceptados y valorados. ¿Qué tipo de agencia es necesaria para la personalidad jurídica? ¿Cuáles son los requisitos cognitivos y racionales que los sistemas legales asumen acerca de los sujetos de la ley? ¿Cómo es que los seres humanos cumplen con estos requisitos? En trabajo previo (Cáceres y Montemayor, 2016), hemos argumentado que estas preguntas requieren un nuevo acercamiento a la teoría del derecho, basado en hallazgos recientes en ciencia cognitiva, que van más allá de tratamientos teóricos neuro-legales contemporáneos. Aquí construimos sobre esta propuesta, (...) ahora enfocándonos en cuestiones de agencia y normatividad, incluyendo tipos de agencia que son relevantes para la epistemología social. La conclusión principal del artículo es que los muy estrictos requisitos cognitivos que se asumen sobre las capacidades explícitas de racionalidad de los agentes cognitivos, presupuestos por la ley, no sólo son incompatibles con los hallazgos en psicología, sino que un análisis sistemático de la agencia moral y epistémica también es necesario para poder entender la normatividad legal. El argumento principal es que tipos de agencia colectiva, moral y epistémica, difieren de la agencia individual, la cual también debe distinguirse como moral y epistémica. Fundamentalmente, la agencia colectiva difiere de la individual no sólo con base en diferencias con respecto a la racionalidad, sino también con base en los criterios de integración informativa. Varias consecuencias de este análisis son evaluadas, incluyendo aspectos concernientes a integración informativa para juicios y decisiones, comunicación fiable para la agencia epistémica, y la integración de consideraciones morales en el razonamiento jurídico. Una revisión comprensiva de la noción de “autonomía” es justificada por esta propuesta, en parte porque los requisitos comunes para la personalidad y autonomía jurídica son muy demandantes e inadecuados en muchos casos, y en parte porque la agencia colectiva debe tomarse en consideración como un tipo fundamental de agencia legal responsable para procesos de integración informativa. Basándonos en la distinción entre formas epistémicas y morales de razonamiento, explicamos cómo los sistemas legales necesitan de altos niveles de integración cognitiva para la responsabilidad legal a nivel colectivo. We extend classical work by Janusz Czelakowski on the closure properties of the class of matrix models of entailment relations—nowadays more commonly called multiple-conclusion logics—to the setting of non-deterministic matrices (Nmatrices), characterizing the Nmatrix models of an arbitrary logic through a generalization of the standard class operators to the non-deterministic setting. We highlight the main differences that appear in this more general setting, in particular: the possibility to obtain Nmatrix quotients using any compatible equivalence relation (not necessarily a congruence); the (...) problem of determining when strict homomorphisms preserve the logic of a given Nmatrix; the fact that the operations of taking images and preimages cannot be swapped, which determines the exact sequence of operators that generates, from any complete semantics, the class of all Nmatrix models of a logic. Many results, on the other hand, generalize smoothly to the non-deterministic setting: we show for instance that a logic is finitely based if and only if both the class of its Nmatrix models and its complement are closed under ultraproducts. We conclude by mentioning possible developments in adapting the Abstract Algebraic Logic approach to logics induced by Nmatrices and the associated equational reasoning over non-deterministic algebras. Este estudio analiza el artículo 146 del Código Orgánico Integral Penal (COIP) de Ecuador, esta trata sobre el homicidio culposo por práctica profesional equivocada. La mala praxis médica es un problema grave en el sistema de salud de Ecuador, y la interpretación inadecuada de este artículo ha generado confusión en los procesos legales relacionados. El objeto de la investigación es analizar la normativa del artículo 146 del COIP y las lagunas de interpretación jurídica para determinar la culpabilidad o inocencia de (...) los profesionales de la salud. Para ello, se emplearán métodos comparativos e históricos, que incluyen revisión bibliográfica, análisis de contenido del artículo 146. Los resultados esperados son demostrar las dudas razonables en la prueba del delito de mala praxis, resaltar la importancia de la bioética en los procedimientos legales. Este estudio busca contribuir a una mejor comprensión del marco legal y brindar ideas para la resolución de casos de mala praxis y homicidio culposo en Ecuador. (shrink)

Cuando un hablante emite una proferencia x, hay ocasiones en las quela audiencia puede entender otra cosa que diverge del significado literalde los signos o símbolos empleados en x; a saber, la audiencia, alescuchar x, entiende y. Sin embargo, esto no se debe a que en algunacircunstancia particular el significado literal de x cambie (éste es atemporale inmutable); pero entonces, cómo o por qué es que en algunasocasiones, por ejemplo en el sarcasmo, la ironía o los albures, la audiencialogra identificar (...) un significado no estandarizado (que puede variarde ocasión en ocasión y que no siempre se infiere el mismo significado“diferente” del literal para una o más proferencias dadas) que se infierea partir no sólo de la expresión empleada, sino también de cómo ésta seemite (tonos de voz, semblantes físicos, guiños, etcétera), bajo qué condiciones(contexto), qué sea lo que “se quiera decir” (intencionalidaddel hablante) y cuál es la respuesta que se espera (expectativa que tieneel hablante de su audiencia).Así, el presente trabajo buscará descibrir precisamente las repuestasa tales interrogantes: cómo y por qué (o con base a qué) podemosentender y al escuchar x sin que nada de la primera esté contenido ni directani indirectamente en el segundo. Para ello abordaré el programa delfilósofo británco Herbert Paul Grice enfocado a la pragmática, en el queexpone la distinción que hay entre el significado literal y el significado delhablante, dándole a este último una singular importancia. Será apresentada uma definição do que seria esse realismo, apresentando exemplos da arte visual, mas também, brevemente, da poesia. Será destacada a comunhão de áreas filosóficas na crítica platônica, pois não só a estética, como a epistemologia, a ontologia e a ética estão presentes no ideário que define a arte como um simulacro do real. In his explanation of human action Alfred Schutz resorts mainly to Max Weber’s notion of subjective meaning and Husserl’s notion of type. For him subjective meaning seems more important to understand human action than the fact that social actors internalize normative values. Accordingly, validity has mainly to do with projects of action, with fulfilled (or unfulfilled) expectations and to the stock of knowledge available, along with the actor’s system of relevances. This raises two characteristic Schutzian problems: 1) the relation between (...) the subjective meaning of an action and the objective criteria (namely, the juridical and the ethical ones) according to which any action can be evaluated; 2) the relation between an actor and his fellow human beings that arguably share the same system of relevances and act in the same normative framework. In this paper, I intend to offer an analysis of these issues, resorting mainly to Schutz’s 1934 book Der Sinnhafte Aufbau der Sozialen Welt, and in some unpublished manuscripts. (shrink)

The passage of time pertains to the dynamic happening of anticipated future events merging into a present actuality and subsequently becoming the past. Philosophers and scientists alike often endorse the view that the passage of time is an illusion. Here we instead account for the phenomenology of time passage as a real psycho-biological phenomenon. We argue that the experience of time passage has a real and measurable basis as it arises from an internal generative model for anticipating upcoming events. The (...) experience of passage is not merely a representation by a passive recipient of sensory stimulation but is generated by predictive processes of the brain and proactive sensorimotor activity of the whole body. Although some philosophical approaches to time consider some psycho-biological evidence, the biological basis of the passage of time has not been examined in detail from a thorough scientific perspective. In this paper I critically assess a proposal called ‘Universal Moral Grammar’ and its implications for legal theory. I explain its relevance with respect to Natural Law approaches to legislation and our moral capacity. I present objections to this proposal and offer behavioral evidence concerning its plausibility as a scientific theory of moral competence. An important conclusion of the article is that lawyers and legal theorist have now the responsibility to look beyond their field, and start taking a more proactive (...) role in the interdisciplinary study of social behavior.Resumen:En este artículo se discute una propuesta denominada “Gramática moral universal” y sus implicaciones para la teoría del derecho. El autor explica la relevancia de esta propuesta en relación con los enfoques iusnaturalistas sobre la legislación y la capacidad moral. A su vez, el estudio presenta diversas objeciones a esta propuesta y ofrece evidencia conductual relativa a su plausibilidad como una teoría científica de la competencia moral. Una conclusión importante del artículo, según el autor, es que los juristas y los abogados contemporáneos tienen la responsabilidad de ir más allá de su propio campo y de empezar a tomar un papel más activo en el estudio interdisciplinario de la conducta social. We present an account of the evolutionary development of the experiences of empathy that marked the beginning of morality and art. We argue that aesthetic and moral capacities provided an important foundation for later epistemic developments. The distinction between phenomenal consciousness and attention is discussed, and a role for phenomenology in cognitive archeology is justified-critical sources of evidence used in our analysis are based on the archeological record. We claim that what made our species unique was a form of meditative (...) and empathic thinking that made large-scale human cooperation possible through pre-linguistic, empathic communication. A critical aspect of this proposal is that the transformation that led to the dawn of our species was not initially driven by semantic or epistemic factors, although clearly, these factors increased the gap between us and other species dramatically later on. Our proposal suggests that recent philosophy of mind and psychology might have "epistemicized" phenomenal consciousness too much by construing it in terms of semantic content rather than by describing it in terms of empathic and meditative thinking. Instead of the prevailing approach, we favor the type of subjectivity that is fundamentally "other-involving" as essential, because on our account, a necessary condition for subjectivity is the empathic understanding of other individuals' psychology, not through inference or judgment, but through immediate conscious engagement. Harm experiences are defined by two sets of traits. In the first place, by the double type of modality of its experience: in contrast with the type of negativity that has been traditionally understood as evil, harm is defined not by its being or being experienced as necessary but by its negative possibility-what is not necessary that it should happen or have happened-and by the practical necessity that it should not happen again. In the second place, harm experiences are worked (...) through in non-symmetrical relational structures between victims or survivors, wrongdoers or victimizers, and the set of third-party figures that attend to them and adopt a concerned attitude towards them, when this is achieved. In virtue of the first set of traits, harms are open to their closure that is articulated, at least, in three types of labors or tasks: its cessation, its reparation or cure, and the commitment of its non-repetition. In virtue of the second set of traits, these tasks entail differential authorities and responsibilities in the three types of figures involved in experiences of harm. (shrink)
